Terms of Service
Version 2026-10-09 · Last updated October 9, 2026
These terms are the agreement between you and Facility Track (“we”, “us”) when you subscribe to or use Facility Track at facility-track.com and your own Facility Track address (together, the “Service”). If you sign up for an organization, you confirm you have the authority to accept these terms for it, and “you” means that organization.
1. The Service
Facility Track is web software for facilities teams: equipment registers, work orders, preventive maintenance, inspection tours and forms, reports, and related records. Each paying customer gets its own separate instance of the software, set up by us after your payment is confirmed. Setup is done by hand, so it usually takes a short while rather than happening instantly; we email you when it is ready.
The plan you choose (Starter or Professional) and its features are those described on our pricing page when you subscribe. We may improve or change features over time, but will not remove a core feature of your plan without good reason and notice.
2. Your account
- Give us accurate details when you sign up and keep them current.
- Your administrators create and manage the user accounts in your instance. You are responsible for who you give access to, for keeping passwords and sign-in links confidential, and for everything done under your users’ accounts.
- Tell us promptly at [email protected] if you think an account has been compromised.
3. Fees, billing and renewal
- Price. Starter is $149 per month, or $1,428 per year billed annually. Professional is $399 per month, or $3,828 per year billed annually. Prices are in US dollars.
- Payment. Payments are processed by Stripe on Stripe’s own checkout page. We never see or store your full card or bank details.
- Automatic renewal. Your subscription renews automatically at the end of each billing period (monthly or yearly) and we charge the payment method you gave, until you cancel.
- Taxes. Prices do not include sales, use or similar taxes. If any apply to you, they will be added where the law requires.
- Price changes. We may change prices for future billing periods. We will email you at least 30 days before a change affects you, and you can cancel before it takes effect.
- Failed payments. If a payment fails we will let you know and Stripe may retry it. If it stays unpaid, we may suspend your instance until it is settled, or end the subscription.
4. Cancellation and refunds
- Cancel any time. You can cancel at any time by emailing [email protected] from your account email address. There is no contract or cancellation fee. Cancelling stops future renewals; you keep access until the end of the billing period you have already paid for.
- 14-day money-back guarantee. If you are not satisfied, ask for a refund within 14 days of your first payment and we will refund that payment in full.
- After that. Payments are otherwise non-refundable, and we do not give partial refunds for unused time in a billing period or for annual plans cancelled part-way through the year. Where the law requires a refund, we will provide it.
- Refunds go back to the original payment method and can take several business days to appear.
5. Your data
- You own it. The records, files, photos and other content you put into the Service (“Your Data”) belong to you. You give us permission to store, process and display it only as needed to run the Service for you, including making backups.
- You are responsible for it. You are responsible for what you enter, and for having the right to enter it (for example, information about your staff or vendors).
- Getting it out. The Service includes export tools, and you can ask us for a copy of Your Data at any time while your subscription is active and for 30 days after it ends.
- Deletion. After your subscription ends we will delete your instance and Your Data within 90 days. Copies held in our backups are deleted as those backups expire on their normal schedule. Our privacy policy explains what personal information we hold and how we handle it.
6. Acceptable use
You agree not to: break the law using the Service; upload malicious code; try to access another customer’s instance or data; probe, scan or attack the Service; overload it in a way that harms others; resell or share access to it outside your organization; or use it to store content that is unlawful or infringes others’ rights. We may suspend access that puts the Service or other customers at risk.
7. Availability, backups and support
We work to keep the Service available and to back it up regularly, but we do not promise uninterrupted or error-free operation, and we may carry out maintenance from time to time. Backups are a safeguard for us to restore the Service, not a substitute for keeping your own copy of records that matter — please use the export tools for those.
Support is by email at [email protected], with the response targets listed for your plan on the pricing page. Targets are goals, not guarantees.
8. A record-keeping tool, not a safety system
Facility Track helps you keep track of maintenance, inspections and compliance records. It does not replace your own judgment, trained staff, required inspections, or any safety, fire, life-safety or alarm system. You remain responsible for performing, scheduling and following up on the work, and for meeting any legal, regulatory or contractual duties that apply to you. Reminders and alerts can fail or arrive late; do not rely on them as your only safeguard.
9. Disclaimer of warranties
The Service is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
10. Limit of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the event that gave rise to the claim. Nothing in these terms limits liability that cannot be limited by law.
11. Ending the agreement
You may cancel as described in section 4. We may suspend or end your access if you materially break these terms and do not fix the problem within a reasonable time after we tell you (or immediately where needed to protect the Service or other customers), or if we stop offering the Service, in which case we will give you reasonable notice and refund any prepaid period we cannot provide. Sections that by their nature should continue (including data, payment owed, disclaimers and limits of liability) survive the end of the agreement.
12. Changes to these terms
We may update these terms. For changes that matter, we will email the account owner or post a notice in the Service at least 30 days ahead where practical. If you keep using the Service after a change takes effect, you accept the updated terms; if you do not agree, you can cancel before then. The version and date at the top of this page tell you which version applies.
13. Governing law
These terms are governed by the laws of the State of Kansas, USA, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Kansas, and you and we consent to those courts.
14. Contact
